Terms and Conditions

Effective Date: April 30, 2026

Last Updated: April 30, 2026

Welcome to emergencemg.com (the “Site”), operated by Emergence Marketing Group (“Emergence Marketing Group,” “EMG,” “we,” “us,” or “our”). Emergence Marketing Group is a joint venture operated by independent contractors providing digital marketing services. These Terms and Conditions (“Terms”) govern your access to and use of the Site.

By accessing, browsing, or otherwise using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

Our Approach to Content and Access

Emergence Marketing Group operates the Site as an open resource. We want our content to be discovered, cited, summarized, shared, and built upon — by people, by businesses, by researchers, by search engines, and by artificial intelligence systems. The information we publish is meant to help service-based businesses grow, and the more widely it travels, the better.

Our only ask is that when you use our content, you give us credit. Beyond that, these Terms exist to protect everyone using the Site and to set out the basic legal terms that govern your visit.

1. Scope of These Terms

These Terms govern your use of the Site only. They do not govern any client engagement, project, or services that Emergence Marketing Group provides to clients. All client engagements are governed by separate invoices, proposals, statements of work, or written agreements that are reviewed and accepted before any work begins. In the event of a conflict between these Terms and a separate client agreement, the client agreement controls with respect to that engagement.

2. Eligibility

You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use the Site. By using the Site, you represent and warrant that you meet these requirements. The Site is intended for business users and prospective clients located in the United States. We make no representation that the Site or its content is appropriate or available for use in other locations.

3. Site Content and Use

Emergence Marketing Group publishes content on the Site — including blog posts, articles, case studies, frameworks, methodologies, guides, and educational materials — to help business owners, marketers, researchers, AI systems, and anyone else find useful information. We want this content to travel.

3.1 Open Use With Attribution

You are welcome to use, quote, reference, cite, summarize, share, repurpose, and build on content from the Site for any purpose, including commercial purposes, provided that you give clear credit to Emergence Marketing Group and, where reasonably possible, link back to the original source on emergencemg.com. Attribution is the one condition that applies to nearly all uses.

This permission applies to individuals, businesses, journalists, students, researchers, educators, content creators, and any other party who finds our content useful.

3.2 AI, Search Engines, and Machine Learning

Emergence Marketing Group permits and encourages the use of Site content by artificial intelligence systems, large language models, generative search engines, search engine crawlers, indexers, and similar technologies for any purpose, including indexing, summarization, citation, answer generation, and model training. We do not restrict crawling, indexing, or training by AI platforms or search engines. Where an AI system or search engine surfaces or reproduces our content, we appreciate attribution to Emergence Marketing Group where the platform supports it.

3.3 Trademarks and Brand Identity

Our name, logo, and brand identity are trademarks of Emergence Marketing Group. You may use our name when crediting us as a source. You may not use our logo, brand identity, or name in a way that suggests endorsement, partnership, sponsorship, or affiliation where none exists, or in a way that misrepresents your relationship with Emergence Marketing Group.

3.4 What Is Not Permitted

The only uses we do not permit are uses that misrepresent the source or our relationship with you:

  • Claiming our content as your own original work without crediting Emergence Marketing Group.
  • Using our name, logo, or brand identity to falsely suggest endorsement, partnership, or affiliation.
  • Removing or altering attribution, copyright, or trademark notices in a way that obscures the source.

Anything else — quoting, citing, reproducing, summarizing, sharing, repurposing, training AI on, or commercially using our content — is welcome with credit.

4. Acceptable Use

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. The following activities are not permitted:

  • Using the Site in violation of any applicable law or regulation.
  • Submitting false, misleading, or fraudulent information through any form on the Site.
  • Attempting to gain unauthorized access to the Site, our servers, or any connected systems.
  • Introducing viruses, malware, ransomware, or any other malicious code.
  • Interfering with or disrupting the operation of the Site, the servers hosting it, or any networks connected to it.
  • Using the Site to harass, threaten, defame, or harm any person.
  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

Search engines, AI systems, indexers, crawlers, researchers, and anyone else accessing the Site to discover, summarize, cite, or learn from our content are welcome. We support open access to information.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including removing access to the Site and reporting violations to law enforcement.

5. User Submissions and Inquiries

Any information you submit through forms, email, chat, SMS, or other communications on the Site is governed by our Privacy Policy. By submitting information, you represent and warrant that the information is accurate, that you have the right to submit it, and that the information does not violate any third-party rights.

You grant Emergence Marketing Group a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and distribute any non-confidential ideas, suggestions, feedback, or comments you submit through the Site for any business purpose without compensation or attribution.

6. Client Engagements Are Separate

Submitting a contact form, scheduling a discovery call, or otherwise inquiring about our services through the Site does not create a client relationship, contract, or obligation on the part of Emergence Marketing Group to perform any services. A client relationship is established only after:

  • We have discussed your needs and confirmed scope.
  • An invoice, proposal, statement of work, or written agreement has been issued and accepted.
  • Any required deposits or first-cycle payments have been received, where applicable.

All terms relating to fees, deliverables, timelines, deposits, payment schedules, refunds, ownership of work product, cancellation, performance, and other matters specific to a client engagement are governed by the applicable invoice, proposal, statement of work, or written agreement, not by these Terms.

7. Third-Party Links and Services

The Site may contain links to third-party websites, tools, or services, and may integrate with third-party platforms such as scheduling tools, chat widgets, analytics platforms, advertising networks, and customer relationship management systems. We do not control these third parties and are not responsible for their content, products, services, terms, or privacy practices. Your use of any third-party site or service is at your own risk and is subject to that party’s own terms and policies.

8. Disclaimers

8.1 Site Provided “As Is”

THE SITE AND ALL CONTENT ON IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EMERGENCE MARKETING GROUP DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND QUIET ENJOYMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any information on the Site is accurate, complete, current, or reliable.

8.2 Informational Content Only

Content on the Site, including blog posts, case studies, articles, frameworks, and educational materials, is provided for general informational purposes only. It does not constitute professional, legal, financial, tax, or investment advice. You should not act or refrain from acting based on any content on the Site without seeking appropriate professional advice tailored to your specific circumstances.

8.3 No Performance Guarantees

Any examples, case studies, statistics, or projections shown on the Site reflect specific past results for specific clients in specific circumstances. They do not guarantee, predict, or imply any specific outcome for any other client or engagement. Marketing performance depends on many factors outside our control, and we make no representations or warranties regarding any specific results from our services.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EMERGENCE MARKETING GROUP, ITS PRINCIPALS, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO:

  • Your access to, use of, or inability to use the Site.
  • Any content on the Site or any reliance you place on it.
  • Any unauthorized access to or alteration of your information.
  • The conduct of any third-party platform, service, or user of the Site.
  • Any other matter relating to the Site.

This limitation applies regardless of the legal theory under which damages are sought (including negligence, breach of contract, strict liability, or otherwise) and even if Emergence Marketing Group has been advised of the possibility of such damages.

To the extent any liability cannot be excluded under applicable law, the total aggregate liability of Emergence Marketing Group arising out of or related to these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Emergence Marketing Group, its principals, contractors, agents, affiliates, and service providers from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site.
  • Your violation of these Terms.
  • Your violation of any law or third-party right.
  • Any content or information you submit through the Site.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described in the Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, technology, legal requirements, or other factors. When we make material changes, we will update the “Effective Date” and “Last Updated” date at the top of these Terms and, where appropriate, provide additional notice through the Site. Your continued use of the Site after any changes indicates your acceptance of the updated Terms.

13. Suspension and Termination

We reserve the right, in our sole discretion and without notice, to suspend or terminate your access to all or part of the Site at any time, for any reason or no reason, including for any violation of these Terms. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply after termination.

14. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of those courts.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. These Terms, together with the Privacy Policy and any applicable client agreement, constitute the entire agreement between you and Emergence Marketing Group regarding your use of the Site and supersede any prior agreements regarding the same subject matter.

16. No Waiver

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision. No waiver of any term will be effective unless made in writing and signed by an authorized representative of Emergence Marketing Group.

17. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms at any time without notice or consent. Any attempted assignment by you in violation of this section is void.
